THE RIGHT TEMPLATE

Where it fits

For a gift of a house, flat or land in India made out of love and affection, with no price. Use the sale deed when a price is paid. Gifts under Muslim personal law (hiba) and gifts of movable property follow their own rules. Sign prepares it to print on e-stamp paper: the donor and the donee sign in ink before two attesting witnesses, and the deed is then registered with the sub-registrar where the property is.

A CAREFUL CHECK

Before you rely on it

Original Centilio wording, not legal advice. A gift of immovable property under sections 122 to 126 of the Transfer of Property Act, 1882. Section 123 needs a deed signed by the donor and attested by at least two witnesses, and section 17 of the Registration Act, 1908 makes registration with the sub-registrar compulsory, within four months of signing. Stamp duty is set by each state on the market value, often at a lower rate for a gift to close family, so check the state's rate and which relatives and kinds of deed it covers. A gift of movable property can also be made by delivery. The deed does not keep a right of residence or a life interest for the donor, set conditions, or deal with a minor donee, joint family property or agricultural land. A gift from someone who is not a relative under income tax law can be taxed as the donee's income. Have a local advocate check it before registration.
